No legal certainty so far!

The German Federal Supreme Court (BGH) left a lot of room for interpretation in its rulings of 9 September 2021 on the labelling obligation of advertising postings. Mag. Jacqueline Bichler and Dr. Arthur Stadler analyze its latest rulings in the current daily newspaper DER STANDARD.

Conclusion: Attention to everybody, who advertises via influencers. In order to defend yourself against UWG claims of surreptitious advertising, good arguments & evidences are recommended (editorial section, blue tick, etc.).
